1.The present writ petitions have been filed aggrieved of
orders dated 29.05.2026 (Annexure-10) and 01.06.2026
(Annexure-7) (in SBCWP Nos.10216/2026 & 10230/2026,
respectively) whereby the services of the petitioners who had
been working as 'Lab Technician' through a placement agency,
[2026:RJ-JP:28745] (16 of 17) [CW-10216/2026]
have been sought to be terminated and of orders dated
27.05.2026 (in SBCWP No. 10233/2026) whereby the persons
selected in terms of the Rajasthan Contractual Hiring Civil Posts
Rules, 2022 (hereinafter referred to as 'Rules of 2022') have been
accorded appointments.
2.This Court in Ravi Chahar Vs. State of Rajasthan & Ors.;
S.B. Civil Writ Petition No. 10325/2026 (decided on
14.07.2026) has already taken a view that after the recruitment
process in terms of Rules of 2022 having been completed, the
earlier employees working through the placement agency would
have no right to continue. In Ravi Chahar (supra), this Court,
while dealing with the said issue held as under:
"6.Admittedly, Rules of 2022 were brought into effect
from 11.01.2022. As per the purpose and intent of the
said rules, they were framed and implemented in
pursuance to a policy decision of the State to enter into a
direct engagement with the employees and remove the
placement agencies in between. Vide the said rules, the
employment was to be made directly by the State
through regular recruitment process, on contract basis.
Further, the Rules of 2022 have not been assailed in the
present writ petition. Furthermore, requisition dated
13.05.2022 whereby the posts were created and
sanctioned for all the Government Medical Colleges as
well as the RajMES Society, has also not been laid a
challenge to in the present petition.
7.In view of the above, this Court is of the considered
opinion that the petitioners have no right to claim
extension as a matter of right as firstly, the
administrative decision of the State whereby the Rules of
2022 were promulgated having not been challenged, no
finding qua the said rules can be recorded by this Court.
Secondly, the action taken by the State in terms of the

Rules of 2022 being not impugned, the appointments
made in terms of the said rules cannot be termed to be
bad. Thirdly, even as per the petitioners, they were
accorded appointment with a specific condition that the
same was being granted till the regularly selected
candidates in terms of the Rules of 2022 are appointed.
The same having been accepted by the petitioners, they
cannot now turn up and say that they are entitled for
extension of their services or not to be replaced by the
persons appointed in terms of Rules of 2022.
8.No case of interference is made out and the present
writ petition is hence, dismissed."
3.Counsel for the petitioners however submitted that the
respondent-Authorities are under the process to fill up the
remaining vacancies again through a placement agency. However,
no document to substantiate the said fact has been placed on
record.
4.In view of the above, no case for interference is made out at
this stage. The writ petitions are disposed of.
5.However, if the respondent-Authorities undertake any fresh
process to fill up the remaining vacancies again through any
placement agency, the petitioners shall be at liberty to approach
afresh before the Court.
6.Stay applications and all pending application(s), if any, stand
disposed of.
