Scheduled Castes. The State had first included them in 1979, then cancelled it in 1984, and modified it in 1987, which was the order under dispute. Petitioners argued that the State lacked the power to alter the Scheduled Castes Order. The question arose whether the State Government could modify the Scheduled Castes Order or conduct inquiries to determine if a community, specifically the Thandan community in the Malabar area, fell within its scope. Finally, the Supreme Court ruled that the Scheduled Castes Order must be applied as it stands, and no inquiry can be held to determine if a community falls within it, as only Parliament can modify the Order under Article 341. The Thandan community, being listed, is entitled to Scheduled Caste benefits throughout Kerala, and the State Government's 1987 order to the contrary was quashed.
