As per case facts, the Petitioner, an Assistant Commandant in BSF, was absent from duty after sanctioned leave due to family illness and his own medical condition, submitting a resignation ... which authorities said couldn't be processed without his physical presence. Despite depositing training costs and continuous communication, his status remained in limbo for years. He later withdrew his resignation and rejoined service after a significant delay. Subsequently, he was chargesheeted, tried by a General Security Force Court (GSFC) for unauthorized overstay, and punished with service forfeiture, which was later reduced. His statutory petitions were rejected, prompting this Writ Petition challenging the disciplinary action and seeking regularization of his absence. The question arose whether his prolonged absence was wilful misconduct or due to compelling circumstances, and if procedural safeguards were observed. Finally, the High Court found the absence was not wilful, noted procedural irregularities, and ruled that the combined punishment and "dies non" treatment constituted double jeopardy.
