As per case facts, the Misquitta family owned land, leased for a long term to C.S. Enterprises partners, who later allegedly sub-leased to A.K. Associates. A.K. Associates developed the property, ... selling flats, leading to the formation of Priya Co-operative Housing Society. When the developer failed to convey the land, the Society applied for Unilateral Deemed Conveyance. Crucially, the Petitioner and other co-owners were not made parties, and notice was not properly served to all owners, including a deceased one. The Competent Authority granted the Deemed Conveyance, and a transfer deed was registered. The Petitioner appeals, contending a gross violation of natural justice and procedural irregularity.
