With Sections 55 & 62 of the Copy Rights Act & Order VII Rule 1 of the
C.P.C, 1908, praying to grant a judgment and decree on the following terms:-
a) for permanent injunction restraining the defendant, their men,
representatives, agents and anybody on behalf of the defendant from in any
manner infringing, exhibiting or exploiting the schedule A movies or any part
thereof through satellite Television Broadcast Direct to Home broadcast, direct
satellite service, internet video streaming through all forms, I.P. TV, broadband,
telephone, telephony, cell phone radio (all dimensions) VCD, DVD, video on https://www.mhc.tn.gov.in/judis

demand, movie on demand, video, High definition (HD), laser disc, blue ray,
U-matic, inflight, airborne, railborne, terrestrial television broadcast (all
dimensions) through cable/via cable TV, local delivery system, MMDS, paper
view, seaborne, all modes of public/private transportation, public service
broadcasting, private communication/broadcast, wire, wireless, 2D & 3D
formats/dimensions of the film or any other formats/dimensions which may be
in existence now or invented in future or through any other forms, means and
modes and any forms of communication like signs, signals, writing, pictures,
images and sounds of all kinds of transmission of electro magnetic waves
through space or through cables intended to be received by the general public
either directly or indirectly through the medium of relay stations and all its
grammatical variations and cognate expressions shall be construct accordingly
or any other systems without restriction of geographical area and including all
channels of Doordarshan and Public Music (A Music Channel of the Defendant)
or any other Tv channel owned and run by the defendant.
b) Direct the respondent to render true and proper accounts of profit in
respect of its infringing, telecasting and exploiting of the said schedule “A”
movies since November, 2017.
c) To pay damages of a sum of Rs.30,00,000/- for exploiting the schedule
“A” movies as detailed in Schedule “B” hereunder thereby causing loss to the
plaintiff.
d) To pay cost.

JUDGMENT
The suit was filed for a permanent injunction, rendition of accounts and
damages in respect of the alleged infringement of the plaintiff’s copyright in the
cinematographic films listed in schedule A of the plaint.
2. Upon service of suit summons, the defendant initially entered
appearance through counsel. After noticing that the defendant had not filed the
written statement and was also not represented by counsel, the defendant was
set ex parte by order dated 05.10.2023.
3. The plaintiff adduced ex parte evidence by examining Mr.M.Jyothi
Basu as P.W.1. In course of the examination in chief of P.W.1, 252 documents
were exhibited as Exs.P1 to P252.
4. Learned counsel for the plaintiff submits that evidence was adduced in
respect of the assignment of copyright in favour of the plaintiff pertaining to
each suit schedule film. By referring to paragraph 5 of the written arguments,
learned counsel submits that the exhibit numbers pertaining to the assignment
agreement, supplementary agreement, wherever applicable, lab letter, censor
certificate and correspondence, wherever appropriate, has been mentioned
therein. By referring to paragraph 6 of the written arguments, learned counsel
submits that evidence of infringement by the defendant has been detailed https://www.mhc.tn.gov.in/judis

therein by providing the screenshots as exhibits. She also submits that a pen
drive containing such screenshots was exhibited as Ex.P251.
5. On the basis of pleadings and the evidence adduced, the plaintiff has
established entitlement to the relief claimed by way of permanent injunction.
While the plaintiff has claimed damages in a sum of Rs.30 lakhs, there is no
evidence of loss of Rs.30 lakhs. However, the plaintiff has also prayed for
rendition of accounts by the defendant by infringing, telecasting and exploiting
the schedule A movies since November 2017. In view of the evidence adduced
with regard to the infringement, the plaintiff is also entitled to this remedy. As
the successful party, the plaintiff is entitled to costs. In the aggregate, the
defendant is liable to pay the plaintiff a sum of Rs.3 lakhs as costs towards court
fees, lawyer's fees and other expenses.
6. In the result, the suit is decreed in terms of reliefs prayed for in
paragraph 14(a) and (b) of the plaint. In addition, the defendant is directed to
pay a sum of Rs.3,00,000/- (Rupees Three Lakhs only) as costs to the plaintiff
towards court fees, lawyer's fees and other expenses.
