As per case facts, on a night in 2001, the appellant Ram Krishna and others entered the complainant Sunita Tiwari's house. Ram Krishna demanded property papers from Suchcha Nand Wadhwani ... and threatened him. When Sunita Tiwari intervened, Ram Krishna fired his gun, injuring her in the stomach. He fired again, missing the victim and hitting a wall. The victim was hospitalized, and a case was registered. The trial court convicted the appellants, who then appealed the judgment and sentence. The question arose whether the trial court was justified in convicting the appellants for offenses under Sections 307 and 450 of IPC and whether the imposed jail sentences and fines were legal and justified. Finally, the High Court affirmed the convictions under Sections 450, 307, and 307/34 of IPC. However, it reduced the jail sentence for Section 307 and 307/34 of IPC from ten years to seven years, and for Section 450 of IPC from five years to three years. The fine amounts for Section 307, 307/34 and 450 of IPC were significantly enhanced, to be paid as victim compensation. The court considered the long time elapsed since the incident and the lack of prior criminal record as mitigating factors for sentence reduction, while acknowledging the seriousness of the crime.
