As per case facts, petitioners, working as Pharmacists, sought the grant of a specific pay scale with arrears from a particular date. They had submitted representations which remained pending and
...relied on a previous High Court order that allowed similar claims for Pharmacists. The question arose whether the High Court should direct the respondent authorities to expeditiously decide the pending representations of the petitioners for the grant of their entitled pay scale and arrears, especially in light of a previous favorable judgment. Finally, the High Court observed that since a common issue was raised and petitioners were seeking a direction for consideration of their representations rather than a decision on merits, it directed Respondent No. 2 (Director, Ayurved, Yog and Natural Medicine Unani Siddha and Homeopathy (Ayush)) to take a decision on all pending representations in accordance with law, expeditiously, and preferably within eight weeks from the date of receipt of the order.
