As per case facts, Rinkoo Kumari and others filed a Writ Petition challenging Rule 2(viii) and Rule 6 of the Bihar Nursing Cadre Rules, 2024, arguing they were discriminatory and ... ultra vires. These rules mandated suitability/recognition certificates from the Indian Nursing Council and Bihar Nursing Registration Council for GNM course candidates, especially from institutes outside Bihar. Petitioners also sought to quash a Press Release regarding registration cancellations and an advertisement for GNM posts based on these rules. The question arose regarding the constitutional validity and discriminatory nature of these rules concerning GNM course recognition and registration. Finally, the High Court noted a notification from the Health Department, Government of Bihar, amending the challenged rules (Rule 2(viii) and Rule 6 of the Bihar Nursing Cadre Rules, 2024).
