As per the case facts, an airport was proposed at Silchar, Assam, on land including tea estates, and activities were initiated without environmental clearance. The appellants approached the National Green
...Tribunal with grievances about this. The question arose whether any activity could be carried out for setting up an airport without environmental clearance as per the relevant notification, and how any future application for environmental clearance should be processed if illegal activities had already occurred at the site. Finally, the Supreme Court directed that no activity should be carried out at the proposed greenfield airport site in breach of the provisions of the Notification dated September 14, 2006. It also mandated that any future application for environmental clearance must be processed based on the site's condition as it existed before any illegal clearing of tea bushes and shade trees took place. The appeals were allowed, and the National Green Tribunal's order was set aside.
