2. Since all these writ applications involve common
issues and prayers as such all the writ applications were heard
together and are being disposed of by this common judgment.
3. All the writ applications have been preferred by
petitioners having common prayer which is quoted
hereinbelow :-
(a) For issuance of an appropriate writ(s), order(s) or direction(s) or a
writ in the nature of Mandamus directing upon the respondents
to grant and confer seniority by treating the notional date of
appointment from the date, when the other similarly situated
candidates appointed through the common process recruitment

being Advertisement No. 21 of 2016 floated by Jharkhand Staff
Selection Commission (JSSC) for the appointment on the post of
Trained Graduate Teachers with all consequential including
financial benefits i.e., increment etc. since the date of joining was
not under their control.
4. Briefly stated, an advertisement being Advertisement
No.21 of 2016 was published by JSSC inviting the eligible
candidates for appointment on the post of Trained Graduate
Teacher (TGT) in different subjects. The results were
published, whereby, final results and recommendation of all
these petitioners have been kept in abeyance by the JSSC,
however, other similarly situated candidates pursuant to the
same recruitment process have been appointed on different
dates in the year 2019 itself.
5. The State of Jharkhand vide notification no. 5938, and
order no. 5939, dated 14.07.2016 declared 13 Districts of the
State of Jharkhand as scheduled districts by giving 100 %
reservation on the basis of the residence for class-III and IV
appointments, however, remaining 11 districts of the State of
Jharkhand were non-scheduled districts, where all these
petitioners have applied for appointment on the post of Trained
Graduate Teacher (TGT), Subject – History and Civics i.e.
District-Palamau, Hazaribagh, Chatra, Bokaro, Giridih,
Godda, Koderma, Dhanbad and Garhwa.

6. Subsequently, a writ petition was filed by one Soni
Kumari & others being W.P (C) No. 1387 of 2017 challenging
the legality of the notification no. 5938, and order no. 5939,
dated 14.07.2016, whereby, 13 districts of the State of
Jharkhand have been declared scheduled district by giving
100% of reservation on the basis of residence for Class – III
and IV appointments, which was heard by full Bench of this
Court and the judgment was pronounced on 21.09.2020
quashing the said notifications with direction to advertise a
fresh selection process in accordance with law. However, in the
said judgment at paragraph No. 66, it was clarified that the
selection process was never stayed in non-scheduled districts.
7. In the Non-Scheduled Districts, the appointments of
Trained Graduate Teachers pursuant to the common
recruitment process was already made in the year 2019 on
various subject.
However, petitioners though were shortlisted for
document verification by JSSC, their results and
recommendation were kept in abeyance by JSSC in spite of the
fact that there was no order of stay by Full Bench of this Court
with respect to the appointments in Non-Scheduled Districts.
8. Majority of the candidates of Non-Scheduled Districts
from the common recruitment process have been appointed in
the year 2019 itself and even for the subject-History and

Civics, appointments have been made in the District-Deoghar
(Non-Scheduled District) w.e.f. 09.01.2019. Details of the

9. Subsequently, due to abruptness, inconsistency,
delay and laches of the authorities, some of the petitioners
including other similarly situated candidate filed writ petition
being W.P (S) No. 338 of 2021 before this Court seeking
issuance of appointment letters in light of Paragraph – 66 of
Judgment of Soni Kumari (Supra). The Writ Petitions were
disposed off with direction to authorities to take decision in
accordance with observations made in the case of Soni Kumar

(Supra) at paragraph—66 and to examine as to whether
petitioners are coming within the zone of consideration or not
and to pass an appropriate reasoned order. Thereafter, another
batch of writ petitions were filed by some of the petitioners
including other similarly situated candidates being W.P (S) No.
936 of 2021 and said batch cases were disposed of upon
submissions made by the Learned Advocate General that a
decision has been taken on 06.10.2021 for appointment of the
teachers in non-scheduled area so far as Subject-History and
Civics are concerned. Thereafter, these petitioners were
appointed in the months of November/December, 2021.
10. After confirmation of the services of these petitioners,
they have made representations before the respondents for
granting notional date of appointments from the date when
similarly situated teachers from common recruitment process
have been appointed in the respective districts; however, all
the efforts of these petitioners went in vain, which forced these
petitioners to knock the doors of this Court.
11. Mr. Sumeet Gadodia, Advocate assisted by Mr.
Amritansh Vats, Advocate submitted that all petitioners have
been appointed almost two years later than the similarly
situated candidates, who have been appointed in the year 2019
in their respective districts, without their fault, but due to

abruptness, inconsistency, delay and laches on the part of the
authorities.
12. It was further submitted that only after the order
dated 11.01.2021 passed in W.P (S) No. 338 of 2021 , a
decision was taken by the respondents for appointment of
petitioners and similarly situated teachers in non-scheduled
areas which is also reflected in the order dated 25.11.2021
passed in W.P (S) No. 936 of 2021 and batch cases. The said
decision was taken by the authorities only after the
intervention of the coordinate bench of this Court, thereafter,
in the months of November/December, 2021, the
appointments of the petitioners were made.
13. It was further contended that on one hand,
appointments of petitioners were delayed for about more than
two years by the authorities and on other hand, candidates
from common recruitment process in respective same districts
were given joining in the year 2019 itself. Thus, joining of the
petitioners were delayed for almost more than two years
without their fault.
14. It was further contended that for the subject – History
and Civics in District-Deoghar (non-scheduled district), the
appointments have already been made in the month of
January, 2019. Further, it was submitted that in a similarly
situated issue with respect to previous recruitment process of

teachers, the authorities have taken a decision to extend the
benefit of notional date of appointment with consequential
benefits including increments.
15. It was further contended that the petitioners are not
demanding back wages for the aforesaid period, but are only
praying for fixation of notional date of appointment with all
consequential benefits including financial increment etc.
16. Per contra, Mr. Manish Mishra, learned Counsel for
Respondent-State submitted that date of appointment shall be
deemed to be the date of joining and, post in question is a
District Cadre post. It was submitted that while appointment
was made through a State Level Merit List, but all subsequent
matters including seniority are governed separately at District
Cadre Level.
17. Further it was submitted that appointments made in
District-Deoghar for the same subject in the month of January,
2019 do not confer upon the petitioners any right to claim
notional joining from the year 2019. It was further submitted
by Mr. Manish Mishra that it is settled law that a person
cannot claim seniority from a date anterior to the date when
he/she was born in the cadre. Thus, in substance, two
objections were raised by State Counsel, namely:-
(i) Post of Para-teachers being District Cadre Post,
Petitioners cannot claim notional appointment and

seniority from an anterior date merely because in
some districts some persons have been appointed
pursuant to common advertisement process.
(ii) Seniority of Petitioners cannot be anterior to the
date on which he/she was born in the cadre.
18. Having heard learned counsels of the parties and on
perusal of the record, it transpires that through a common
advertisement process, vide Advertisement No. 21 of 2016,
process of appointment to the post of Trained Graduate
Teachers was initiated. However, such appointment process
fell in dispute because of 100% reservation in scheduled
Districts, but there was no such dispute in respect of non-
scheduled Districts. In fact, in respect of non-scheduled
Districts, appointments were made in the year 2019 itself of
several persons in various subjects, and, despite the fact that
Petitioners along with other candidates were called for
documents verification between the month October, 2018 to
December, 2018, their results were belatedly published only in
the month of December, 2020 and, subsequently, they were
appointed in the year 2021.
19. In fact, in the case of Soni Kumari & Ors vs State of
Jharkhand & Ors reported in 2020 SCC OnLine Jhar 797 ,
the Full Bench of this Court has clarified that the selection
process was never stayed by the Court in non-scheduled

districts, where these petitioners were seeking appointments.
The relevant paragraph is quoted as under:-
“66. We also propose to make it abundantly clear that by
the ad Interim order dated 18.9.2019 passed by this Court
in these writ applications, the selection process was never
stayed by the Court in the non-scheduled districts, though,
as informed to us, it had erroneously been taken by the
State Government like that. There was no stay for
appointments on any post in the non-scheduled districts, or
for that matter there was no stay for the appointments even
in the scheduled districts, rather, only the operation of the
Notification No. 5938 dated 14.7.2016 was stayed by this
Court. In other words, the appointments could be continued
to be made even in the scheduled districts, ignoring the
aforesaid notification.”
20. Pursuant to clarification made in paragraph-66 of
Soni Kumari (Supra), the coordinate bench of this Court vide
order dated 11.02.2021 in W.P (S) No. 338 of 2021 filed by
petitioners and similarly situated persons made observation
and directions which is quoted as under:-
4. Mr. Amritansh Vats, learned counsel appearing for the
petitioners submits that pursuant to Advertisement No.21 of
2016, the petitioners applied for the post of Trained
Graduate Teacher (TGT) for Districts Palamau, Garhwa,
Chatra, Dhanbad, Bokaro, Koderma, Giridih and Godda in
the subjects of History and Civics. The petitioners appeared
in both the examinations i.e. compulsory and mains
examination and after successfully qualifying in both the
examinations, the petitioners were called for
counselling/document verification vide different
notifications dated 04.10.2018 and 14.12.2018 published
in the website of Jharkhand Staff Selection Commission in
which the roll numbers of the petitioners are also appearing
in Palamau, Garhwa, Chatra, Dhanbad, Bokaro, Koderma,
Giridih and Godda, subjects History and Civics. The
petitioners had appeared in document verification
procedure/counselling in the light of aforesaid notification
for District Palamau, Garhwa, Chatra, Dhanbad, Bokaro,
Koderma, Giridih and Godda in the subjects of History and
Civics and during the said counselling, the petitioners had
submitted all the relevant documents including educational
qualification and as per the demand of JSSC, the

respondent-JSSC had successfully accepted the relevant
documents without any objection from any corner.
5. Mr. Amritansh Vats, learned counsel for the petitioners
further submits that now the matter can be disposed of in
the light of the judgment passed by the Full Bench of this
Court in the case of Soni Kumar & Others vs. The State
of Jharkhand & Others delivered in W.P.(C) No.1387 of
2017 vide order dated 21.09.2020 particularly Para 66
which is quoted herein below:-
"66. We also propose to make it abundantly clear
that by the ad interim order dated 18.9.2019
passed by this Court in these writ applications,
the selection process was never stayed by the
Court in the non-scheduled districts, though, as
informed to us, it had erroneously been taken by
the State Government like that. There was no
stay for appointments on any post in the non-
scheduled districts, or for that matter there was
no stay for the appointments even in the
scheduled districts, rather, only the operation of
the Notification No. 5938 dated 14.7.2016 was
stayed by this Court. In other words, the
appointments could be continued to be made even
in the scheduled districts, ignoring the aforesaid
notification."
6. Mr. Amritansh Vats, learned counsel for the petitioners
also submits that the petitioners are belonging from
non-scheduled districts and there is no stay of
operation and in view of the observation made in
Paragraph 66 of the Full Bench judgment, the writ
petition can be disposed of for considering the case of
the petitioners.
7. Mr. Tejo Mistry, learned counsel appearing for
respondent-Jharkhand Staff Selection Commission
submits that the writ petition can be disposed of only to
the effect that the JSSC will examine as to whether the
petitioners are coming under the zone of consideration
or not and if they are under the zone of consideration,
appropriate order will be passed.
8. In view of above facts and considering the submission
of learned counsel for the parties, the writ petition is
being disposed of with direction to the petitioners to file
fresh representation before respondent no.2 within a
period of three weeks from today. If such
representation is filed before respondent no.2, he will
take a decision in accordance with the observations
made in Full Bench judgment in the case of Soni Kumari
(supra) and he will examine as to whether the
petitioners are coming within the zone of consideration
or not. The respondent no.2 will pass appropriate
reasoned order within a period of eight weeks
thereafter.
9. With the above observations and directions, this writ
petition stands disposed of.

21. Thereafter, in yet another writ petition filed by the
some of the petitioners and similarly situated person, the co-
ordinate bench of this Court vide order dated 25.11.2021 in
W.P (S) No. 936 of 2021 and batch cases has passed following
observation which is quoted as under:-
Heard the parties.
All these writ petitions have been filed by the petitioners
commanding upon the respondents to appoint the
petitioners on the post of Trained Graduate Teacher in
subject History-Civics, pursuant to Advertisement No.
21/2016, as the names of these petitioners were
recommended by the Jharkhand Staff Selection
Commission for non-scheduled districts.
At the very outset, learned Advocate
General, representing the State, submits that now the
State has taken a decision on 6.10.2021 for
appointment of teachers in non-scheduled areas, so far
as History-Civics subject is concerned.
In view of the submission of learned
Advocate General, the cases regarding appointment of
teachers in non-scheduled areas of the concerned
subject i.e. History-Civics has become infructuous, since
their cases for appointment has already been
considered by the State pursuant to decision dated
6.10.2021.
Accordingly, all these writ petitions,
which relate to appointment of teachers of History-Civics
subject in non-scheduled areas, are dismissed as
infructuous.
22. After pronouncement of above-mentioned orders,
respondents have appointed petitioners on different dates in
the month of November and December, 2021 in their respective
non-scheduled districts.
23. The judgment of Soni Kumari (Supra) was challenged
before the Hon’ble Supreme Court in the case of Satyajit
Kumar & Ors. Vs. State of Jharkhand & Ors . reported in
(2022) 18 SCC 284, whereby, the Hon’ble Supreme Court

directed the State-Respondents to publish revised merit list
with respect to entire State including respective candidates
belonging to scheduled and non-scheduled areas on the basis
of the individual merit list. The relevant paragraph is quoted
as under: -
“111. However, at the same time, the directions issued by the
High Court in the impugned judgment and order while setting
aside all the appointments made pursuant to the
Notification/Order dated 14-7-2016 and Advertisement No. 21 of
2016 dated 28-12-2016 as modified on 4-12-2017 and to go in
for fresh/de novo recruitment process for the Scheduled
Areas/Districts is hereby modified. It is now directed that
instead of fresh/de novo recruitment process by setting aside the
appointments already made in the Scheduled Districts/Areas,
the State shall revise the merit list based on the already
published cut-off obtained by the last selected candidates in
each TGT subject against the respective categories with respect
to entire State and respective candidates belonging to the non-
Scheduled Areas and Scheduled Areas (districts) shall be
adjusted accordingly on the basis of individual merit of the
candidates.”
24. From aforementioned observations of Hon’ble
Supreme Court, it would be, thus, evident that Hon’ble
Supreme Court itself directed for preparation of Merit List with
respect to entire State, both for scheduled area and non-
scheduled area and candidates were directed to be adjusted on
the basis of individual merit of the candidates.
25. From the documents available on record, it would be
evident that though a common recruitment process i.e.,
Advertisement No. 21 of 2016 was published, but parity in
issuing appointment letters to similarly situated teachers was
not maintained and even at District level, some candidates

were given appointment letters where appointment of other
candidates were withheld. Moreover, as per direction of Hon’ble
Supreme Court, common Merit List at State Level was required
to be prepared.
26. Thus, objection of Respondent-State that Petitioners
cannot claim seniority with other similarly situated employees,
who were appointed in one or the other District pursuant to
common advertisement process, is not sustainable as it was
due to latches on the part of Respondent itself that Petitioners
were denied the benefit of appointment.
27. In fact, Petitioners are only claiming notional shifting
of date of appointment with benefit of seniority and notional
fixation of pay, etc. without claiming any back wages.
28. In this regard, the reference has been made to the case
of C. Jayachandran vs State of Kerala & Ors reported in
2020 (5) SCC 230; wherein at paragraph no. 39, the Hon'ble
Supreme Court has held as under: -
"39. The appellant was wrongfully excluded from the
process of appointment on account of an illegal and
arbitrary grant of moderation of marks. The Government
in its Order dated 22-12-2010 cancelled the appointment
of three District and Sessions Judges who were granted
benefit of moderation. Badharudeen was earlier
assigned general category seat but since the appellant
was higher in merit, Badharudeen was pushed down
and adjusted against OBC category seat at Sl. No. 42.
Badharudeen has not challenged his pushing down at Sl.
No. 42 either before the learned Single Bench of the High
Court or before the Division Bench of the High Court or
even before this Court. Therefore, as respondent, he
cannot be permitted to dispute the grant of seniority to

the appellant at Sl. No. 41. The judgment referred to by
the learned counsel is not helpful to the arguments raised
as the appellant therein sought seniority as direct recruit
from the time when the vacancies occurred. To raise such
an argument, reliance was placed upon judgment of this
Court reported in Union of India v. N.R. Parmar [Union of
India v. N.R. Parmar, (2012) 13 SCC 340: (2013) 3 SCC
(L&S) 711), wherein this Court held that a person is
disentitled to claim seniority from the date he was not
borne in the service. The said finding is in the context of
the claim of the appellant to claim seniority from the date
of availability of the vacancies; whereas in the present
case, the appellant is claiming seniority from the date the
other candidates in the same selection process were
appointed but the appellant is excluded on account of an
illegal act of the High Court of the moderation of marks.
Therefore, the said judgment is not of any help to the
arguments raised."
29. Similar issue was also involved before the coordinate
Bench of this Court in W.P.(S) No. 1778 of 2017 and W.P.(S)
No. 206 of 2022; wherein grievance of those petitioners was
that respondents were not granting the seniority/notional
seniority with effect from the date of appointment of similarly
situated employees recruited through common recruitment
process. The coordinate Bench of this Court in both the writ
applications have directed the respondents to issue suitable
order treating the date on which other candidates were
appointed as the date of appointment of the petitioner and it
was also directed that respondents should give notional date
of appointment with effect from the date when other candidates
were appointed.
30. This Court also while dealing with the similar issue of
Engineers employed in Jharkhand Urja Vikas Nigam Limited

(JUVNL) in W.P (S) No. 4007 of 2022 and W.P (S) No. 3459
of 2021 has held as under: -
“15. Having regard to the aforesaid discussions and also
the judgment passed by the Hon'ble Apex Court and by the
Coordinate Bench of this Court, both these writ applications
are allowed, mainly for the reasons that the name of these
petitioners were wrongfully excluded from the process of
appointment, for no fault of these petitioners.
16. Accordingly, the respondent-Board is directed to treat
the date on which other candidates pursuant to
Advertisement No. 01 of 2008 dated 20.09.2008 were
appointed, as the date of appointment of these petitioners.
The respondents are further directed to issue
appropriate order giving notional date of appointment with
effect from the date on which other candidates pursuant to
the said advertisements were appointed.
17. As a result, these writ applications stand disposed of,
in the manner indicated hereinabove. Pending I.A.s, if any,
also stands disposed of.”
31. Having regard to the aforesaid discussions and also
the judgments passed by the Hon’ble Supreme Court, all the
writ applications are allowed mainly for the reasons that due
to delay and laches on the part of the State, their appointments
have been kept in abeyance for more than two years for no fault
of these writ petitioners, which has also been observed in
paragraph – 66 of the judgment of Soni Kumari (Supra) and
only after intervention of this Court, the appointments were
made.
32. Accordingly, the respondents are directed to treat the
date on which initial appointments have been made in
respective districts in the year 2019 pursuant to the

Advertisement No. 21 of 2016 as the date of appointment of
these petitioners.
33. Respondents are further directed to issue appropriate
order giving notional date of appointment with effect from date
on which the other candidates were initially appointed
pursuant to the same advertisement in the respective districts
with all consequential benefits including seniority, increments,
upgraded pay scale etc. except back wages.
34. The entire exercise shall be completed within a period
of 12 weeks from the date of receipt/production of copy of this
order.
35. Accordingly, all these writs’ applications stand
allowed. Pending I.A.s, if any, also stands disposed of.
