Sections 107 and 145 of the Criminal Procedure Code and also filed a Civil Suit for injunction, securing a status quo order. Proceedings under Section 107 were subsequently dropped. The Magistrate, however, also dropped the Section 145 proceedings, which the High Court affirmed, reasoning that the appellant had resorted to a Civil Suit. The father appealed to the Supreme Court. The question arose whether the pendency of a Civil Suit, especially when there is no dispute of title, prevents the continuance of proceedings under Section 145 of the Criminal Procedure Code, particularly after Section 107 proceedings are dropped. Finally, the Supreme Court held that while a Civil Suit usually prevents invoking criminal jurisdiction, this applies when title is in dispute. When title and right to possession are not disputed, and the issue is solely possession, dropping Section 107 proceedings cannot be the basis for dropping Section 145 proceedings. The Court allowed the appeal and directed the appellant to be placed in possession.
