The appellant-wife appealed, contending the Family Court overlooked husband's cruelty, her medical condition, dowry harassment, and falsely attributed actions to her without evidence, resulting in a perverse judgment. The question arose whether the Family Court's finding of cruelty was based on proper appreciation of evidence or if it was perverse. Finally, the High Court found that the Family Court did not properly consider the veracity of mutual allegations, especially the wife's consistent testimony of cruelty by the husband, and thus the finding of cruelty was perverse. Consequently, the impugned judgment was quashed.
